Bad news for superintendent who had job offer rescinded for using word 'ladies' in email
The Massachusetts school administrator who had a $151,000 job offer rescinded after using the word 'ladies' to his woke colleagues has just suffered another blow after a judge threw out his lawsuit.
Vito J. Perrone was set to to become superintendent of Easthampton Public Schools in Springfield, about 100 miles west of Boston, in March 2023. But he had his job offer yanked when his new bosses took offense to his email greeting using the word 'ladies.'
'Ladies,' Perrone wrote to school officials amid contract negotiations at the time. 'Good evening! I perused the contract and have three requests.'
The greeting received immediate backlash from the hyper-woke school committee, which claimed it was a 'microaggression' and voted 5-1 to rescind the offer.
But Perrone fought back and later sued the district. He claimed his rights were violated and that the job offer was a binding agreement.
Over a year later, a federal judge dismissed his case, claiming no contract ever existed.
Judge Mark Mastroianni said last week that since the full committee never voted to approve Perrone's requests, including a 3 percent raise, 30 vacation days, and 18 sick days per year, the deal wasn't final.

Cynthia Kwiecinski was the chairperson of the committee and told Perrone his offer would be withdrawn on Thursday
Perrone's argument that a verbal agreement made during a phone call with Kwiecinski amounted to a binding deal was ultimately rejected by the judge.
In a 17-page ruling, Mastroianni dismissed Perrone's lawsuit and claimed the there was no enforceable contract and therefore no constitutional violation.
'It is apparent from the face of the complaint that there was no enforceable agreement, as Plaintiff rejected the School Committee's initial offer by responding with a counteroffer,' Mastroianni said.
'On the record before the court, there is no plausible support, whether direct or inferential, for Plaintiff's legal conclusion that an enforceable contract was created by the March 29 email.
'The court is therefore persuaded that Massachusetts public policy requires an affirmative vote of the School Committee to accept any alterations to a previously offered employment agreement.'

Perrone began his teaching career in Carson City in Nevada after playing professional football in Italy for four years
'As a matter of law, no enforceable contract is formed until such a vote occurs.'
The judge threw out Perrone's main claim with prejudice which means it cannot be filed again.
Perrone told the Daily Hampshire Gazette in 2023 that he was taking a pay cut to take the job. He had been the principal of Easthampton Highschool eight years prior.
'This job was not about the money for me. I honestly felt like I was coming home to Easthampton. I coached football here. I was principal here when we built the school.'
'I have such wonderful memories … I was excited to come back,' he said in an interview with the Gazette.
According to Perrone, Kwiecinski said that using 'ladies' was a microaggression and 'the fact that he didn't know that as an educator was a problem.'
'I was shocked,' he said. 'I grew up in a time when 'ladies' and 'gentlemen' was a sign of respect. I didn't intend to insult anyone.'

Perrone had been the principal of Easthampton High School eight years prior and viewed his new job as coming 'home'
He said he was attending a fundraiser dinner in the high school on Thursday night when he was planning to go to a conference room for negotiations with the committee. Instead, he was asked to leave the room for 45 minutes before being told that his offer would be rescinded following a vote.
'I don't want people to think I was not willing to negotiate in good faith. I have chosen not to just leave it as 'negotiations stalled.' I would rather share my truth, my sadness and disappointment and try to find a way forward positively,' he told the Gazette.
